Guide

What employment advice is and when you need it

Employment advice (asesoría laboral) answers your questions about work before they turn into a dispute: your payslip, your collective agreement (convenio colectivo), your holidays or a change in your working hours. We put you in touch with a bar-registered employment adviser, an independent employment lawyer.

  1. What an employment adviser does

    • Reviews contracts, payslips and final settlements (finiquitos), and checks that the correct collective agreement is being applied.
    • Explains your rights on working hours, overtime, holidays and leave; for example, what happens if you are signed off sick during your holidays.
    • Assesses a change in working conditions, a disciplinary sanction or a dismissal letter.
  2. Employment advice for companies and the self-employed

If you have employees, it helps you choose the contract after the labour reform, keep working time records, prepare the protocol against sexual harassment and harassment on grounds of sex and, with 50 or more people, the equality plan. See the guide to the employment contract.

  3. Online employment adviser and claims

Many questions can be resolved by phone or video call. If the company does not put things right, the next step is usually a formal claim or a conciliation request (papeleta de conciliación). For hostile and continued treatment, see the workplace harassment lawyer; for an open dispute, an employment lawyer.

Employment advice for workers

Almost everything starts with something small: a job category that doesn’t match, overtime that doesn’t appear on your payslip or a shift change imposed on you. Unpaid wages can be claimed for one year; a dismissal, only within 20 working days: see the dismissal lawyer.

Who's who

Employment adviser, payroll agent and employment lawyer: the differences

All three work on employment matters, but they do not do the same thing.

Payroll agent or gestoría

An agency that handles the administrative side.

What they do
Payslips, social security contributions, and registering and deregistering workers with Social Security.

Graduado social

A professional registered with their professional body who specialises in employment and Social Security matters.

What they do
Advises and can represent you before the employment courts (juzgados de lo social).

Employment lawyer (abogado laboralista)

This is the option when the question may end in a claim or a court case.

What they do
Advises and defends at any level of court and in any jurisdiction, including all appeals.

For payslips, a gestoría; to know what rights you have and how to defend them, legal employment advice.

Frequently asked questions

Questions about employment advice

What is the difference between employment advice and a payroll gestoría?

The gestoría handles the paperwork: payslips, social security contributions, registering and deregistering workers. Legal employment advice analyses your rights and tells you how to act if there is a dispute.

Can I consult an employment adviser online?

Yes. Many questions can be resolved by phone or video call if you send the contract, payslips and relevant documents beforehand.

What documents do I need for an employment enquiry?

Your contract, your latest payslips, your employment history report (informe de vida laboral) and any letter or message from the company about your case, including any dismissal or sanction letter.

How much does an employment adviser cost?

It depends on the matter: a one-off consultation, a review of documents or ongoing advice for companies. Always ask for the quote in writing before starting.

How do I know which collective agreement applies to me?

It usually appears in the contract or on the payslip. It depends on the company's main activity and the territory; it is published in the Official State Gazette (BOE) or in regional or provincial gazettes.
