Plan how to protect and pass on your wealth: will, gifts, family business and taxes. We put you in touch with specialist, English-speaking lawyers and tax advisers.
Deciding in your lifetime how your estate will be shared out avoids disputes between your children and tax surprises.
If you have a family business
Handing over to the next generation needs a legal and tax plan so that the business keeps running.
If you have assets in several countries
Living or owning assets outside Spain multiplies the rules and taxes that have to be coordinated.
Guide
What wealth planning is and how it helps you
Wealth planning advice (asesoría patrimonial) analyses what a family owns (a home, savings, a business, assets abroad) and designs, on legal and tax grounds, how to protect it and pass it on. We put you in touch with specialists in wealth planning and succession planning.
01
What a wealth plan includes
Diagnosis: assets and debts, the matrimonial property regime, regional civil status (vecindad civil) and tax residence.
Future protection: lasting powers of attorney (poderes preventivos) and naming your own guardian in advance (autocuratela), in case one day you cannot decide for yourself.
02
Succession planning: the basis of everything
Under the Civil Code, if you have children, two thirds of the estate are the forced heirship share (legítima) and only one third is freely disposable; Catalonia, Aragon, Navarre, the Basque Country, Galicia and the Balearic Islands have their own rules. With assets abroad, see international inheritances. Start by making a will.
03
When to start
Before it is needed: when you marry, when a child is born, when you buy property or when you retire. If a family member has died, a specialist inheritance lawyer will guide you through the paperwork.
The family business and handing over to the next generation
Without a plan, the heirs may have to sell it to pay taxes. The Inheritance and Gift Tax reductions have strict requirements: shareholding, management duties, remuneration and keeping the business for several years. A family protocol (protocolo familiar) decides who runs it.
Taxes
The taxes in wealth planning
It is not about dodging taxes, but about not paying more than the law requires.
Inheritance and Gift Tax (Impuesto sobre Sucesiones y Donaciones): devolved to the regions (autonomous communities); several give relief of up to 99% to children and spouses, but not all.
Personal income tax (IRPF): giving away a property that has risen in value generates a capital gain for the giver; inheriting it does not.
Wealth tax (Impuesto sobre el Patrimonio): it affects large estates and depends heavily on the region.
Municipal capital gains tax (plusvalía municipal): it is paid when you inherit urban property or receive it as a gift.

Questions about wealth planning
What is the difference between wealth planning and a financial adviser?
A financial adviser recommends what to invest in. The wealth planning advice you can get through us is legal and tax advice: who owns each asset, how it is passed on and what taxes are paid.
From what level of wealth is it worth it?
There is no minimum figure: with a home and two children there are already important decisions to make. Even more so with several properties, a business, children from different partners or assets abroad.
Is it legal to pay less tax through planning?
Yes, if you apply the reductions and reliefs the law provides and meet their requirements. Artificial transactions with no purpose other than paying less are not.
Would an asset-holding company suit me?
It depends. It can make sense with several properties or investments and for organising the succession, but it has running costs and its own tax treatment: you have to do the sums.
What is a lasting power of attorney (poder preventivo)?
A power of attorney signed before a notary so that someone you trust can act for you if in the future you need support to make decisions. It is complemented by naming your own guardian in advance (autocuratela).
