When it pays to have an inheritance lawyer

  • After a death

Certificates, declaration of heirs, acceptance and inheritance tax within 6 months: without missing deadlines.

  • When there's no agreement

A division nobody is happy with, forced heirship shares that have been infringed or one heir blocking everything: better to negotiate than to go to court.

  • To plan in your lifetime

A good will or a properly made gift avoids disputes and can save tax.

Step by step

The first steps in an inheritance

Four steps, in order, from the death to accepting or renouncing.

  1. Once 15 working days have passed, request the certificate of last wills (certificado de últimas voluntades): it shows whether there is a will and which notary it was signed before.
  2. Request the copy of the will or, if there isn't one, the declaration of heirs (declaración de herederos) before a notary.
  3. Draw up an inventory of the assets and the debts, and value them.
  4. Decide whether you accept or renounce: under benefit of inventory (a beneficio de inventario) you are not liable for the debts with your own assets.

What a specialist inheritance lawyer does

A death brings paperwork, banks and deadlines. Specialist inheritance lawyers guide you from the first certificate until the assets are in your name, and defend you if a dispute arises.

  • Wills, gifts and planning

They also work beforehand: they help you make a will that respects the forced heirship shares, organise wills and legacies and plan gifts from parents to children without tax surprises. Inheritance or legacy? Read how they differ.

  • Disputed inheritances

If there is no agreement, the lawyer negotiates (selling the asset or awarding it to one heir who compensates the others) or applies for judicial division (what to do if your siblings won’t divide the inheritance). If the will infringes your forced heirship share or was signed without capacity, they will assess whether to contest the will.

  • Inheritances with assets or heirs abroad

If the deceased lived abroad, had assets in another country or one of the heirs does not live in Spain, the European Succession Regulation comes into play. A lawyer specialising in international inheritances determines which law applies and where the taxes are paid.

Dividing the estate, forced heirship and taxes

Under the Civil Code, children are entitled to two thirds of the estate and the surviving spouse to a life interest (usufructo) in part of it; the rules change depending on the regional civil status (vecindad civil) (how an inheritance is divided by law). The lawyer prepares the partition document (cuaderno particional) and the inheritance tax return (Impuesto sobre Sucesiones): 6 months, extendable by another 6 if the extension is requested within the first 5.

Frequently asked questions

Questions about inheritance

How long do you have to accept an inheritance?

There is no short deadline, but any interested party can ask the notary to call on you to accept or renounce within 30 calendar days; if you do not reply, the inheritance is deemed to be accepted outright.

What happens if there is no will?

The heirs are, in this order, descendants, ascendants, the spouse, siblings, nephews and nieces and other relatives up to the fourth degree and, last of all, the State. A declaration of heirs before a notary is needed.

Do I have to pay the deceased's debts?

Only if you accept. If you accept outright, you are liable even with your own assets; under benefit of inventory, only up to the value of what you inherit. You can also renounce.

How much does an inheritance lawyer charge?

It depends on the value and complexity of the estate: a fixed fee or a percentage of the estate. Ask for the quote in writing before starting.

Can an inherited property be sold if one heir doesn't want to?

Nobody is obliged to remain in joint ownership, unless the testator has prohibited it: any heir can ask for the estate to be divided and, if the asset cannot be divided, for it to be sold and the money shared out.
