What a property lawyer does for you
Buying or selling a home is often the biggest transaction of a lifetime. In a home sale and purchase, a property lawyer reviews everything before you sign. Read about the most common risks when buying a home.
01
Drafting or reviewing the contracts
The deposit contract (contrato de arras) and the sale and purchase contract set the price, the deadlines, who pays each cost and what happens if one of the parties pulls out. A mistake in a single clause can cost you the whole deposit.
02
Notary, taxes and registration
The lawyer reviews the draft title deed (escritura), works out the taxes – for the buyer, transfer tax (ITP) on a resale property, or VAT (IVA) and stamp duty (AJD) on a new build; for the seller, municipal capital gains tax (plusvalía municipal) and, where applicable, personal income tax (IRPF) – and checks that the purchase is entered in the Land Registry, which protects you against third parties.
Disputes over the property
Breaches of contract, hidden defects (the general time limit for claiming for them under the Civil Code is six months from handover), problems with the owners’ community or with the developer. The sooner they are looked at, the more options there are.
Checklist
What to check before buying a home
Four checks before you hand over the deposit or sign the title deed.
Land registry extract (nota simple): it is requested online, costs a few euros and shows the owner and any charges.
Mortgages, seizure orders or other charges: they must be cancelled or deducted from the price, because they stay with the property.
That the annual property tax (IBI) and community fees are up to date: for the deed you need the certificate of debts.
If you need a mortgage, that the deposit contract covers what happens if you are not granted it; otherwise you could lose your deposit.
Buying, selling, a deposit contract or a problem with your home: that's all we need.

Questions about property lawyers
Do I have to hire a lawyer to buy a house in Spain?
No: a notary is enough. But the notary certifies the signing and doesn't act for either party; the lawyer checks the property, contracts and taxes with only you in mind.
How much does a property lawyer charge?
It depends on the transaction: a fixed fee or a percentage of the property's price. Ask for a written quote before they start.
What does the lawyer check before you buy a home?
The land registry extract (nota simple), which shows the owner and any charges, any unpaid annual property tax (IBI) or community fees, the planning status, the energy certificate, and that the contract correctly sets out the price, deadlines and costs.
What happens if the seller pulls out after signing the deposit contract?
It depends on the type. With a penitential deposit (arras penitenciales), a seller who withdraws must return double the amount; with a confirmatory deposit (arras confirmatorias), you can demand that the sale goes ahead, or cancel it and claim damages.
Can you help me if I'm buying a home from abroad?
Yes. If you do not live in Spain, a property lawyer in Spain can arrange your NIE, sign on your behalf under a notarised power of attorney and take care of non-resident taxes.
